Adding Speed and Consistency to Attorney Review

Is predictive coding a defensible approach to ediscovery? No matter how you answer, you will be met with contention. While predictive coding is a valuable tool to maintain costs proportional to the scale of a controversy, it does not yet offer the same assurances as attorney's eyes-on review in the face of severe sanctions for discovery misconduct. That's right, despite dizzying expense, attorney review is still a necessary step in the ediscovery process.

So, while we wait for predictive coding to become smart enough to disarm opposing counsel of spoliation claims or time-consuming "discovery about discovery" proceedings, it is prudent to make the attorney review process less costly and more efficient.

The most time-saving application within the electronic review arsenal is email threading. More times than not, discovery review consists of making sense out of oceans of emails that must be organized by relevance, people involved in an email conversation, email attachments and duplicates.

Email threading reduces the time and complexity of reviewing emails by gathering all forwards, replies, and reply-all messages together into a set of all-inclusive emails. The advantages of email threading are two-fold:


  1. Speed of review - When you use email threading the reviewer will see emails pre-organized to show the longest Inclusive email, which contains all the shorter emails. This increases speed of the review because the reviewer knows what the email thread is after reading the first email and can appropriately code its subsequent iterations.
  2. Consistent coding decisions -  If you don't apply email threading, a reviewer will get an email and code it one way while another reviewer could get the same email later in the review and code it differently. This can can cause major headaches if one reviewer codes the email for privilege and the other reviewer codes it responsive and it gets produced.
